Complainant held a Jeweller’s Block Insurance Policy for her Jewellery Shop. She lost certain golden ornaments from her shop and lodged Claim for loss sustained in the stock of jewellery. According to the Complainant, two ladies posing customers visited her shop while the shop was at closing for the day. On request, she showed them Claim and Beauties and they tried it, but left the shop saying that they would come the next day. The Complainant could find the loss only the next morning. Documents and submissions perused. It is observed that the loss has occurred under mysterious circumstance / disappearance or unexplained reasons falling within the ambit of Section IV (2) (b) of the Policy Conditions. Further observed that the subject loss also attracts Section IV (8) (c). Repudiation upheld.
