Complainant’s insured building got damaged due to inundation caused by torrent rain. Respondent admitted the claim and sent Discharge Voucher of Rs. 6,110/- which was not acceptable to the Complainant because of huge difference between the Complainant’s Estimate of Rs. 33,017/- and Suveyor’s Estimate of Rs. 12,235/-. It is observed that the difference emerged due to reduction in quantity and rate for each of the items indicated in the Complainant’s Estimate. The Building was newly constructed with good quality materials and the Surveyor also reported it is of a Class – A construction. By applying the Rate given by the Complainant’s Engineer on quantitative estimate, salvage value and depreciation as adopted by the Surveyor, the net amount payable arrived at Rs. 12,250/- which was awarded to the Complainant.
