A 27-year-old youth, who was injured in an accident with a rashly driven car, has been awarded a compensation of over Rs 12 lakh, nearly Rs five lakh more than what he had sought, by a Motor Accident Claims Tribunal (MACT).
The tribunal awarded Rs 12,67,640 to Geeta Colony resident Rishi Sharma, who was injured in a road accident two years ago. Sharma had sought a compensation of Rs seven lakh.
“I am of the considered view that there is no reason to disbelieve the testimony of petitioner (Sharma) and other witnesses on this issue and accordingly, petitioner succeeded in proving that on May 4, 2010 an accident had taken place due to rash and negligent driving of offending vehicle being driven by respondent number 1 (driver).
“I accordingly, grant a compensation to the tune of Rs 12,67,640 to the petitioner with interest,” MACT Presiding Officer B S Chumbak said.
The Tribunal directed National Insurance Company Ltd, with which the offending car was insured, to pay the amount.
Sharma, who was employed with a private firm and was earning Rs 36,000 per month at the time of the accident, said the incident took place when in May 2010 when he was returning home on his scooter from his office in Noida.
He said when he Shastri Nagar here, the offending WagonR car, which was rashly driven by driver Vijay Kumar Yadav, hit him and due to this impact, Sharma received multiple injuries and was taken to a hospital.
The tribunal noted that Sharma’s injuries resulted in 19 per cent permanent disability in relation to his right lower limb and said “such nature of disability should have been considered as 50 per cent of the total percentage of the disability towards whole body”.
It said that the pain and suffering of Sharma cannot be measured in terms of money as the suffering is going to be with him for his whole life.
The car owner, however, said he had never employed Yadav or engaged him as his driver of his car.
