New India Assurance Company to pay Rs 62L compensation to the family members of a man, who died in a road mishap involving a rashly driven truck in Uttar Pradesh three years ago, by a Motor Accident Claims Tribunal here.
The tribunal directed the New India Assurance, with which the offending vehicle was insured, to pay a sum of Rs 62,77,120 to the wife, two children and parents of deceased Jitender Singh Negi.
“As such, in view of the testimony of petitioner (victim’s wife) and certified copies of criminal record produced, no doubt is left in respect of the deceased (Negi) having fatal injuries in road traffic accident on September 11, 2009 due to rash and negligent driving of the truck by the driver of the offending vehicle,” MACT Presiding Officer S C Malik.
The tribunal said the victim’s family has proved the negligence of truck driver Wali Ram. Thirty five-year-old Negi’s family told the court that on the day of incident, the victim along with his cousin was going on their motorcycle on work.
The motorcycle was being driven by Negi’s cousin and he was travelling as a pillion rider. As they crossed Hindon bridge in Uttar Pradesh, a rashly driven truck hit them from behind, the family said.
As a result, both the motorcycle occupants fell down and received grievous injuries and were taken to a hospital where Negi died after some time, while his cousin was discharged. Victim’s wife said Negi, resident of Alipur here, was in a government job and was earning over Rs 23,000 per month along with other perks.
The driver and owner of the truck said it was a fabricated case and they have been falsely implicated in it. Awarding the compensation, the tribunal said it is a lifetime trauma for the family and no amount of money can wipe their tears.
