The family members of a 21-year- old youth, who was crushed to death last year by a rashly driven tempo here, has been awarded a compensation of over Rs 10 lakhs by a Motor Accident Claims Tribunal (MACT).
The tribunal ordered Future Generali India Insurance Company Ltd, with which the offending vehicle was insured, to pay Rs 10,22,800 to the kin of Varun Kumar, who had died in the accident when he was walking with one of his friends at Sadar Bazaar area here.
Kumar, who was working with a private firm, was hit from behind by the vehicle driven by Suresh on October 2 last year and he was rushed to a nearby hospital where he was declared brought dead by the doctors.
“In view of the unrebutted testimony of the petitioners (family members of Kumar) and documents available on record, it is prima facie proved that the deceased (Kumar) died due to injuries caused by rash and negligent driving of respondent number one (driver of the vehicle),” MACT Presiding Officer Dinesh Bhatt said.
During the adjudication of the case, the driver of the vehicle had denied any negligence on his part and blamed Kumar and his friend claiming that they were in drunken state.
The tribunal, after going through the case records and statements of the witnesses, said that the driver and the owner of the vehicle were jointly and severally liable to pay the compensation but as the vehicle was insured, the insurance company would pay the amount of Rs 10,22,800 to the family members of the victim.
