Case No. 11 / 004 / 0090

Mr. R. V. Patel

Vs.

United India Insurance Co. Ltd.

Complainant insured his Car under Private Car Package Policy. The Car was stolen on 28.2.03. Respondent admitted the Claim and sent Discharge Voucher for Rs. 2,00,000/- based on the lowest of valuations which the Complainant refused to accept, I. E. V. being Rs. 3.80 lacs. Documents perused. It is observed that there are 3 Valuations out of which two were obtained by the Respondent and the third one was obtained by the Complainant.

Nothing found incredible in the valuation of Complainant’s Surveyor. The dispute being only on quantum of loss, the Golden Mean applied to resolve the complaint. Accordingly, awarded Rs. 2,32,000/- to the Complainant.
