By an interim Award dated 14.05.2004 the Respondent was directed to make an On Account payment of Rs. 170000/- to the Complainant and for resolving the dispute finally, it was suggested to submit to this Forum, a joint Report prepared by the Surveyor and a Chartered Accountant appointed by the Respondent which was submitted on 09.10.2004. In the final Hearing on 17.01.2005, the items of doubt are not considered relevant. As regards the argument of Respondent that the Surveyor found the stock on 15.09.2002 in half part of the shop, it is opined that it cannot be a critical basis for inferring backward that at the time of loss also the Shop was having only half part of stock because, after the loss by Riots, the volume of business in subsequent months may be reasonably low. In addition to an Account Payment of Rs. 1.70 lakhs, the Respondent to pay Rs. 146727/- to the Complainant.
