The Complainant, Radheshyam Singh informed that his truck was torched by the insurgents when it was being used for transporting bamboos from Bijapur.
After fleeing from the scene, the driver and the labourers lodged an FIR at the Bijapur police station.
Complainant also informed the insurance company about the incident. The company sent their surveyor to the spot to investigate the incident.
After surveying the truck, surveyor said that it could not be repaired on the spot because it had burnt completely.
Complainant Singh brought the truck to the Jagdalpur garage where mechanic told him the approximate expense for repairing work of the truck that came around Rs1,17,4160.
In his complaint to the district forum, Singh stated that he was forced to seek the district forum’s interference when the insurance company did not respond to his insurance claims.
After having heard both the parties, forum asked the insurance company to pay Rs4,10,000 to the complainant.
The court also directed the insurance company to compensate Rs10,000 for mental agony and Rs3,000 as litigation charges to the complainant Singh.
