Recently, the Supreme Court denied an insurance company’s appeal against a National Consumer Disputes Redressal Commission decision that upheld a particular claim. The insurer rejected the claim due to the non-production of the driver’s license. The driving license was, however, burned in the collision, according to the Surveyor’s Report. “Still, the Insurance Company insisted on producing the document, which was beyond the control of the insured” , according to the Court.
A bench consisting of Justices MR Shah and Aniruddha Bose denied the insurer’s appeal against the District Forum and NCDRC’s decisions against this backdrop. “In the above facts and circumstances of the case, we find that no error has been committed by the District Forum as well as by the National Consumer Disputes Redressal Commission [in brief, “NCDRC”] in allowing the claim. We find no justification to intervene in the NCDRC’s contested order. “Therefore, the civil appeal is dismissed,” the tribunal stated in its order.
